Terms of Service

These Terms of Service govern your use of wadegreens.com and your purchase of products from Wade Greens, Inc. By using this site or buying from us, you agree to them. If you don't agree, please don't use the site.

Our store is hosted by Shopify Inc., which provides the e-commerce platform that lets us sell to you.

We may update these terms. The current version is always on this page, and the date at the bottom tells you when it last changed. Continuing to use the site after a change means you accept it.

1. Who can order

You must be at least 18 to buy from this site, or have a parent or guardian's consent. You may not use our products for any unlawful purpose, and you may not transmit malicious code to the site.

Breaking these terms ends your right to use the site.

2. Living goods

Almost everything we sell is alive. That has consequences worth stating plainly:

Plants vary. Two plants of the same variety differ in size, shape, branching and color. Photographs show a representative plant, not the exact one you'll receive.
Size descriptions are approximate and refer to the plant at the time of shipping, not its mature size.
Bare-root stock and bulbs ship dormant — leafless and brown. That is the correct condition, not damage.
Hardiness zones are guidance, not a guarantee. A plant rated for your zone can still fail in a bad winter, the wrong soil, or the wrong spot. We'll help you choose well, but we can't guarantee a plant thrives once it's in your ground.
Availability is seasonal and finite. We grow what we sell. A crop can fail. If we can't fill your order we'll tell you and refund it.

3. Orders and pricing

Placing an order is an offer to buy, which we accept when we confirm it. We may refuse or cancel any order — including for availability, a pricing or description error, or where we suspect fraud or resale. If we cancel, we'll contact you using the details on the order and refund you in full.

Prices are in US dollars and exclude tax and delivery, which are calculated at checkout. Prices can change without notice. We may limit quantities per person, household or order.

You agree to give accurate, current billing and contact information, and to keep it up to date so we can complete your order and reach you if something changes.

4. Delivery

How your order travels depends on what's in it — produce is Alabama-only and hand-delivered, nursery stock ships across the continental US, merchandise ships nationwide. The detail is in our Shipping Policy, which forms part of these terms.

Risk of loss passes to you on delivery. If your order arrives damaged, dead or wrong, our Refund Policy sets out how we put it right.

5. Returns and refunds

Nothing needs to be shipped back to us — these are living and perishable goods. Our good-condition guarantee and the claim window are set out in our Refund Policy, which forms part of these terms. Sale items and gift cards are final.

6. Accuracy of the site

We try to keep descriptions, prices and images accurate, but we don't warrant that everything on the site is error-free or current. Some material is historical and provided for reference. We may correct errors, change content, or cancel orders affected by an error, including after you've ordered.

Colors on screen are not exact. Your monitor is not our greenhouse.

7. Your account

If you create an account you're responsible for keeping your login details confidential and for activity under your account. Tell us promptly if you think someone else has access.

8. Intellectual property

The text, photographs, graphics, logos and growing guides on this site belong to Wade Greens, Inc. and are protected by copyright and trademark law. You may not reproduce or redistribute them without our written permission. You're welcome to link to us.

9. Things you send us

If you send us reviews, photographs, ideas or other material, you give us permission to use, edit and publish it without payment or obligation. You're responsible for what you send: it must be yours to send, and must not be unlawful, abusive, obscene, or infringe anyone's rights. We may remove content at our discretion, but we're not obliged to monitor it.

10. Third-party links and tools

The site uses third-party services, and may link to third-party sites. We don't control them and aren't responsible for their content, products or practices. Review their terms before you use them. Complaints about a third party's product go to that third party.

11. Prohibited uses

You may not use this site for any unlawful purpose; to solicit unlawful acts; to violate any law or regulation; to infringe anyone's intellectual property; to harass, abuse, defame or discriminate; to submit false information; to upload viruses or malicious code; to collect or track other people's personal information; to spam, phish, crawl or scrape; for any obscene purpose; or to interfere with the site's security. We may end your access for any of these.

12. Disclaimer and limitation of liability

We don't guarantee the site will be uninterrupted, timely, secure or error-free, and we don't warrant the results you'll get from using it. The site and everything on it is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement.

To the fullest extent permitted by law, Wade Greens, Inc. and its officers, employees, agents and suppliers are not liable for any indirect, incidental, special, punitive or consequential damages — including lost profits, lost revenue or loss of data — arising from your use of the site or any product bought through it. Where liability cannot be excluded, it is limited to the amount you paid for the product concerned. Some states don't allow these exclusions, in which case our liability is limited to the maximum the law permits.

13. Indemnification

You agree to indemnify and hold harmless Wade Greens, Inc. and its officers, employees, agents and suppliers against any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or third-party right.

14. Severability

If any provision of these terms is found unlawful or unenforceable, it will be enforced to the fullest extent permitted and severed to the extent it can't be, without affecting the rest.

15. Termination

These terms apply until terminated by either of us. You may end them by ceasing to use the site. We may end them at any time if we believe you've breached them, and you'll remain liable for amounts owed up to that point. Obligations incurred before termination survive it.

16. Entire agreement

These terms, together with our Shipping Policy, Refund Policy and Privacy Policy, are the whole agreement between us and supersede any earlier understanding. Our failure to enforce a provision isn't a waiver of it.

17. Governing law

These terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts serving Clay County, Alabama.
